Special Event- Live at 5 on Lakeshore 00:00:42

Nolan’s has submitted a Special Event application to use the Kershaw gazebo on Wednesday evenings over the summer to host a live band every Wednesday from 5 to 8 p.m. through July and August. Courtnei Wells, Nolan’s Event Planner, will be in attendance to answer questions.


Lakeshore Drive 3-Way Stop Proposal 00:05:45

Recent concerns have been expressed about pedestrian safety at the crosswalk from Scoops to the City Pier on Lakeshore Drive. To enhance traffic control and ensure safety at the pedestrian crosswalk to the east leg of the City Pier, City Staff recommends the installation of a three-way intersection and eliminating the no left turn restriction. Implementing a three-way stop can contribute to a safer, and more predictable driving environment, benefiting both drivers and pedestrians.

North Bloomfield Road- NYSEG Dispute 00:57:39

Generally when a municipality commences a street improvement project, like the North Bloomfield Road Reconstruction Project, it is the cost of any relocation of utilities is the responsibility of the utility companies that are within the public right-of-way (ROW) as it is an obligation that stems from their license/franchise as there is no actual property right. when a utility exists within a private easement and must be relocated as part of a public project, a municipality may be liable to compensate the utility for the relocation costs, but only if the utility company was being required by the municipality to relocate the lines within the private easement. the City and NYSEG are in dispute about a section of gas main on North Bloomfield that NYSEG has invoiced the City $211,156.45 to relocate a portion of the gas main that serves North Bloomfield Road from a private easement to the public ROW. neither the City nor its engineer, Hunt EAS, required or requested that NYSEG move its utility from the private easement, nor was the City provided with NYSEGs plans and invoice until after the design of the road was complete and the City awarded a contract for the project, as such City Staff does not believe that NYSEG is entitled to any payment for its utility work. In order to continue the project, prevent further/longer disruption to the City residents and additional costs relative to the City’s contractor, the City Manager and Corporation Counsel recommend paying the NYSEG invoice, under protest and with full reservation of rights to pursue reimbursement. This would require City Council authorization to use project contingency.


T-Mobile Lease Renewal 01:06:20

In 2002, the City entered into a lease agreement with Omnipoint Holdings, Inc., for the installation of cellular equipment at the water tower on North Main Street. The lease was subsequently assigned to TMobile and with that, new lease terms have been negotiated; four (4) additional and successive five (5) year terms with an annual rent of $35,000 per year increasing by 15% per Renewal Term. The new lease terms are attached for review by the Committee.
