Recently, attorney Jerry King of the Law Office of Robert King, PLLC and Stag Liuzza, LLC contacted the City about pursuing recovery costs associated with damages related to PFOA and PFOS. Mr. King was invited to the meeting to discuss the matter with the City Council to consider retaining the firm which has been working with other regional municipalities.


NYSDOH Presentation - Swim Beach Regulations 00:28:05

The City has the largest public beach on Canandaigua Lake; however, on occasion, questions arise about the City’s swimming regulations at Kershaw and Lakefront Parks. City Code prohibits bathing, wading or swimming except for the Kershaw Swim Beach. The New York State Department of Health regulates swim beaches and the City is required to obtain a permit annually to operate a swim beach. The City Code is consistent with these regulations. Representatives from the NYSDOH have been invited to provide information about the regulations the City must follow and answer questions.


Ghost of Roseland Update 01:03:13

The Ghost of Roseland committee is requesting an opportunity to provide an update regarding the sculpture project at Lakefront Park, including a formal unveiling/ribbon cutting and signage.


Canandaigua Lady Sewer Pump Agreement 01:13:49

The City has owned and maintained a sanitary sewer pump out station adjacent to the City’s public dock in Lakefront Park. The pump out station which has been used primarily by the Canandaigua Lady was identified as needing replacement. City Staff has reached a tentative agreement (attached) with Canandaigua Lady for the replacement, operation, and maintenance of the pump station for the City Council’s consideration.


MS4 Public Comment 01:16:36

As part of recent changes to regulations and requirements for Municipal Separate Storm Sewer Systems (MS4), the City is required to develop, implement and enforce a stormwater management plan (SWMP) to reduce the discharge of pollutants to the maximum extent practicable and protect water quality. The draft SWMP has been developed and is ready, in draft form, for public presentation. Peter Virkler, Coordinator of Public Works, will present the plan.


Prior Written notice local law 01:20:53

In light of recent litigation in the City of Albany, NYCOM has a recommended an update to our prior written notice law. Chapter 16.2 of the City Charter is consistent with NYS General Municipal Law that the City is not liable for damages or injuries unless there was a prior written notice and the City failed to remove the defect within a reasonable amount of time after such notice. As a result of the Albany litigation, it is recommended that a local law be adopted to specify as to what is considered written notification. Attached is a sample local law for review and consideration as well as the City Charter.
